Privacy Policy

This Privacy Policy explains how American Mediation collects, uses, and protects information when you visit americanmediation.com (the "Site") or use our mediation referral and administrative services (the "Services"). American Mediation serves licensed attorneys and the represented parties they bring to mediation. By using the Site or Services, you agree to the practices described below.

1. Who We Are

American Mediation is a California-based mediation referral and administrative platform that connects litigation attorneys with independent mediators and handles the administrative coordination of mediation, including scheduling, agreements, and payment. References to "we," "us," and "our" mean American Mediation.

2. Information We Collect

Information you provide directly

When you submit a case for mediation, contact us, or otherwise interact with our Services, we may collect:

  • Attorney contact and professional information, including name, law firm, email address, telephone number, and State Bar number;
  • Case-related information, including client name, case caption, case number, opposing counsel contact information, case type, case posture, and a description of the dispute;
  • Scheduling, availability, and mediator-preference information;
  • Any other information you choose to provide in communications with us.

Because our Services involve legal matters, information submitted to us may include sensitive or confidential case details. We treat such information with the confidentiality appropriate to its nature and use it only to provide and administer the Services.

Information collected automatically

When you visit the Site, we and our service providers may automatically collect certain information through cookies, pixels, tags, and similar technologies, including:

  • Device and browser information, such as IP address, browser type, operating system, and device identifiers;
  • Usage information, such as pages viewed, links clicked, time spent on pages, and referring URLs;
  • Marketing and attribution data, such as UTM parameters, referral sources, and information about how you arrived at the Site (for example, from a search engine, an advertisement, or a social media platform).

Information from analytics and advertising technologies

We use, or anticipate using, third-party analytics and advertising technologies to understand how visitors use the Site and to measure and improve our marketing. These may include:

  • Web analytics services (such as Google Analytics) that report on Site traffic and usage patterns;
  • Advertising and conversion-tracking pixels from platforms such as Google, Meta (Facebook/Instagram), and LinkedIn, which help us measure the effectiveness of advertising and reach relevant audiences;
  • Cookies and similar technologies that support these functions.

These third parties may collect information about your online activities over time and across different websites when you use our Site. We do not control the data-collection practices of these third parties and encourage you to review their privacy policies.

3. How We Use Information

We use the information we collect to:

  • Provide, coordinate, and administer mediation Services, including matching attorneys with mediators, scheduling sessions, preparing agreements, and processing payments;
  • Communicate with you about your case, your inquiries, and our Services;
  • Contact opposing counsel, where you have provided their information, to coordinate a mediation;
  • Operate, maintain, secure, and improve the Site and Services;
  • Understand Site usage and measure and improve our marketing and advertising;
  • Comply with legal obligations and enforce our Terms of Service; and
  • Protect the rights, property, and safety of American Mediation, our users, and others.

4. How We Share Information

We do not sell your personal information for money. We may share information in the following circumstances:

  • With mediators and counsel: to coordinate a mediation, we share relevant case and contact information with the selected mediator and, where appropriate, with opposing counsel.
  • With service providers: we share information with vendors who perform services on our behalf, such as form processing, website hosting, analytics providers, payment processors, and e-signature providers. These providers are permitted to use information only to perform services for us.
  • With advertising and analytics partners: as described in Section 2, we may share certain online activity and device information with analytics and advertising technology providers. Depending on how these technologies operate, such sharing may be considered "sharing" or a "sale" under certain California laws. See Section 7 for your rights.
  • For legal reasons: we may disclose information if required by law, subpoena, or legal process, or to protect rights, property, or safety.
  • In a business transfer: if American Mediation is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.

5. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Site, remember your preferences, analyze usage, and support marketing. You can usually control cookies through your browser settings, and you can opt out of certain advertising cookies through industry tools such as the Digital Advertising Alliance (optout.aboutads.info) or the Network Advertising Initiative (optout.networkadvertising.org). Some browsers offer a "Do Not Track" signal; because there is no common industry standard for responding to such signals, our Site does not currently respond to them.

6. Data Retention and Security

We retain personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your California Privacy Rights

Depending on applicable law and our data practices, California residents may have the following rights with respect to their personal information:

  • Right to know the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties with whom we share it;
  • Right to delete personal information we have collected, subject to certain exceptions;
  • Right to correct inaccurate personal information;
  • Right to opt out of sale or sharing of personal information, including certain uses of advertising and analytics technologies;
  • Right to non-discrimination for exercising your privacy rights.

Under California's "Shine the Light" law, California residents may also request information about disclosures of personal information to third parties for their direct marketing purposes.

8. Attorney and Client Confidentiality

American Mediation works exclusively with parties represented by licensed attorneys. We understand that information shared with us in connection with a mediation may be sensitive, confidential, or subject to mediation confidentiality protections under California law. We use case information only to provide and administer the Services and do not use it for advertising or sell it. Nothing in this Privacy Policy is intended to waive any applicable privilege or confidentiality protection.

9. Third-Party Links

The Site may contain links to third-party websites and services, including our intake form provider. We are not responsible for the privacy practices of those third parties, and this Privacy Policy does not apply to them.

10. Children's Privacy

The Site and Services are intended for use by attorneys and businesses, not by children. We do not knowingly collect personal information from individuals under 18. If you believe we have collected information from a minor, please contact us so we can address it.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above. Material changes will be reflected on this page, and your continued use of the Site or Services after an update constitutes acceptance of the revised policy.
