David Oken, Esq.

David Oken is a successful mediator with 30 years of extensive mediation and legal experience in insurance, construction and real property litigation as well as numerous areas of civil disputes such as insurance coverage cases, contract disputes, real estate transactions, construction litigation, real property disputes, personal injury cases, business and employment disputes. As the recipient of the highest quality mediation training at the Straus Institute for Dispute Resolution, Mr. Oken’s significant involvement in numerous types of civil disputes provides him with unique skills to help parties resolve their disputes through mediation.

Mr. Oken has represented national insurance companies in insurance coverage litigation and disputes pertaining to numerous commercial insurance claim issues and he has represented policyholders in all types of insurance coverage issues, including involvement in many practice areas of civil lawsuits. Mr. Oken handled numerous types of cases ranging from high-profile national pollution and toxic tort liability insurance claims to complex construction defect claims to real estate disputes to individual first party homeowner’s and personal injury claims and everything in between.

Mr. Oken also has trial and appellate experience prior to becoming a full-time mediator.

David Oken believes that mediation generally provides the best outcome for disputing parties. His philosophy is to engage in mediation utilizing an approach that does not waste the parties’ time but which spends enough time to relentlessly engage with the parties to permit the parties to find common ground sufficient to resolve their dispute. David’s overall strategy is to never give up on achieving a mediated resolution while maintaining empathy for the parties and a little dose of humor.

David is a full-time mediator specializing in the resolution of civil disputes with a particular specialty for cases involving insurance and complex insurance coverage issues as well as real estate issues. David is a mediator with decades of extensive and recognized attorney experience, on both sides of the “v”, in complex, high profile litigation and mediation which primarily focused on insurance coverage disputes, real estate transactions, real property disputes, personal injury, business disputes and employment issues.

David has a significant breadth of legal experience concerning a large variety of legal cases including national environmental pollution, toxic tort and general liability cases. As a full-time mediator, David has mediated many cases involving a number of legal disputes including insurance coverage litigation and cases involving insurance, personal injury lawsuits, construction defect cases, real estate and land use cases, lawsuits against municipalities, attorney fee disputes and even personal injury cases involving prisons.

David chose and completed the Straus Institue for Dispute Resolution at the Pepperdine Caruso School of Law mediation training program because it is considered one of the premier mediation educational programs in the world and has provided Mr. Oken with invaluable and world class mediation training. The Mediating the Litigated Case program required the successful completion of forty-eight hours of intensive course work and mediation scenarios.

To obtain an additional mediation perspective, Dave completed the twenty-four hour mediation training program with the County of Los Angeles Department of Consumer and Business Affairs.

David has also completed mediation training courses provided by the United States District Court, Central District as well as the California Association of Realtors.

David’s education includes the receipt of his Juris Doctor degree from Southwestern University School of law in 1994 and Bachelor of Science (Business Administration/Marketing) from California State University, Northridge in 1987.
